Imperial Grass Limited – Terms & Conditions

1. Definitions

  • Company: Imperial Grass Limited.

  • Customer: Any individual or entity purchasing goods/services from the Company.

  • Goods: Artificial grass and related products supplied by the Company.

  • Services: Installation and landscaping services provided by the Company.

  • Contract: Agreement between the Company and the Customer incorporating these terms.

  • Warranty: Coverage period of 10, 15, or Lifetime years, depending on the product and installation. A warranty certificate is issued upon completion.


2. Orders, Quotations & Cancellations

  • Quotations: Valid for 30 days unless withdrawn earlier.

  • Orders: Binding only when accepted in writing by the Company.

  • Cancellations:

    • Orders for bespoke, made-to-order artificial grass cannot be canceled or refunded.

    • If installation has begun, cancellations are not permitted.

    • Customers canceling non-bespoke products within 14 days (if unused) must cover return costs.


3. Pricing & Payments

  • Prices are subject to change before order acceptance.

  • Full payment is due upon completion unless otherwise agreed.

  • The Company may securely store card details for final balance payments and reserves the right to charge the card if payment is not received within 24 hours of completion.

  • Late payments incur a £50 daily fee until settled.


4. Delivery & Installation

  • Customers must provide clear and safe access to the site.

  • The Company is not liable for:

    • Minor surface variations or seam visibility.

    • Damage caused by external factors such as extreme weather, reflections, or improper use.

    • Cleaning requirements due to stains from machinery or materials used.

  • Customer Responsibilities:

    • Ensure surface suitability for installation.

    • Remove obstacles and protect delicate surfaces.

    • Obtain any necessary permissions for installation.

    • Provide accurate site measurements.


5. Warranty & Maintenance

  • Coverage:

    • 10, 15, or Lifetime warranty, depending on product and installation.

    • Covers UV stability, tensile strength, and material integrity.

  • Exclusions:

    • Damage due to misuse, neglect, improper cleaning, or force majeure.

    • Issues related to subsidence, tree roots, wild animals, or third-party work.

    • Burns caused by bi-fold doors, mirrors, or other reflective surfaces.

  • Maintenance:

    • Artificial grass requires regular upkeep, including brushing and moss/algae removal.

    • A professional annual maintenance service is recommended to extend longevity.


6. Liability & Indemnity

  • The Company is not liable for indirect, incidental, or consequential damages, including loss of profits.

  • Customers assume full responsibility for any unauthorized modifications, improper use, or failure to follow maintenance guidelines.

  • The Company reserves the right to modify specifications to comply with regulations or improve performance.


7. Force Majeure

The Company is not liable for delays or failures due to events beyond its control, including but not limited to natural disasters, strikes, supply chain disruptions, or government regulations.


8. Risk & Title

  • Risk in the goods passes to the Customer upon delivery.

  • Title remains with the Company until full payment is received.


9. Client Responsibilities & Site Conduct

9.1 Access & Delays

  • The client must grant Imperial Grass Limited full and unrestricted access to the property for the duration of the project.

  • Any delays caused by the client, including but not limited to restricted site access, additional requests, or failure to meet agreed-upon deadlines, will incur an additional labour charge of £500 per day + VAT. Depending on project complexity and staff assignments, this rate may be higher.

9.2 Site Conduct & Behaviour

  • Clients must not interfere with or micromanage our team. Our staff are skilled professionals, and they must be allowed to perform their duties without interruption.

  • Any form of verbal, physical, or written abuse, harassment, or disrespect towards our team will not be tolerated.

  • In cases of abusive behaviour, the Company reserves the right to cease work immediately, and the full project payment will be due immediately, regardless of completion status.

9.3 Material Responsibilities

  • If the client is supplying materials, they must ensure all required materials are delivered on-site and ready for use prior to the agreed start date.

  • If materials are unavailable, causing delays to the project, the client will be liable for our daily labour charge, as outlined in Clause 9.1.

  • The Company is not responsible for sourcing, correcting, or replacing client-supplied materials unless agreed in writing.

9.4 Additional Site Considerations

  • Clients must ensure that the site is clear of obstacles, allowing for smooth project execution.

  • If unforeseen conditions arise (e.g., hidden underground obstructions, hazardous materials, incorrect site information provided by the client), additional charges may apply.

  • Any third-party contractors hired by the client must not interfere with our workflow, and the client is responsible for coordinating all external work without delaying our progress.

9.5 Dirt & Damage to Client Property

  • While the Company will take reasonable steps to protect the work area and the trajectory leading to it, some damage may occur due to the nature of heavy materials and equipment.

  • The Company is not liable for damage to tiles, walls, decking, driveways, landscaping, or any other property caused by necessary movement of materials or equipment.

  • Clients are encouraged to take necessary precautions, such as covering vulnerable surfaces or moving fragile items, prior to project commencement.

  • The Company shall not be liable for loss of profit, business disruption, or depletion of goodwill resulting from any project-related work or incidental damages.

  • The client agrees to indemnify the Company against all claims arising from damage, delays, or unforeseen incidents unless caused by proven negligence.

By agreeing to these Terms & Conditions, the client acknowledges their responsibilities and agrees to comply with the above provisions
